Terms of Use

These terms and conditions ("Terms") and the Privacy Policy(collectively "Terms of Use") are the rules, terms, and conditions as applicable and the amended provisions about the relevant matters of Relief and your use of it, as might be amended from time to time. This Terms of Use are generated by a computer system and do not require any physical or digital signatures.

PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY AND DO PAY ATTENTION TO THE RESPECTIVE DEFINITIONS; IF YOU DO NOT FULLY UNDERSTAND AND AGREE TO ALL OF THE FOLLOWING TERMS OF USE, OR THE PRIVACY POLICY, PLEASE DO NOT USE THE SERVICE OF Relief. YOUR COMMENCEMENT OF, OR CONTINUED USE OF THE SERVICES, OR REGISTRATION OF YOUR OWN ACCOUNT ON Relief MEANS THAT YOU, RECEIPT AND SUFFICIENCY OF THE FOLLOWING TERMS AND CONDITIONS IS WELL ACKNOWLEDGED, AGREE TO BECOME A PARTY TO AND TO BE BOUND BY THIS TERMS OF USE.

Please refer to our Privacy Policy for information on how we collect, use, and disclose information from our users. You acknowledge and agree that your use of the Service is subject to Privacy Policy.

1. Definitions

1.1 "Affiliate" shall mean any Person who directly or indirectly, controls, is controlled by, or is under the common control of Relief entity. The term "Control" is used in the sense of the possession by a Person or a group of Persons acting in concert, directly or indirectly, of the right to direct or cause the direction of the management and policies of another Person, whether through the board of directors or ownership of voting rights by such other Person, by the Articles of Association, contract or otherwise. A Person or a group of Persons acting in concert shall be deemed to be in control of a body corporate if such Person or group of Persons is in a position to appoint or appoints the majority of the directors of such body corporate.

1.2 "Authority" shall mean any union, national, state, local, or other governmental, statutory, administrative, regulatory, or self-regulating authority, agency, or instrumentality having judicial or administrative jurisdiction over the relevant matter.

1.3 “Content” shall mean all any data, text, information, usernames, images, graphics, photos, profiles, audio, and video clips, sounds, other works, applications, links, views, updates, articles, reviews, or comments provided, generated, created, or shared through Relief.

Relief and its licensors exclusively own all right, title, and interests in and to the Services and Content, including all associated intellectual property rights. You agree not to remove, alter or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Services or Content.

Subject to your compliance with these Terms, Relief grants you a limited, non-exclusive, non-transferable, non-sublicensable license to view, copy and display the Content solely in connection with your permitted use of the Services.

1.4 "Information" means and shall include any non-confidential, confidential, non-personal, and/or personally identifiable information or other information provided to Relief during your use of Relief. Details of the process of information on Relief are further provided under Relief’s Privacy Policy.

1.5 "Internal Service Provider" shall mean reputable logistics or any back-end service providers of Relief appointed by Relief that will provide various services that Relief may require in order to run operations of Relief for example to facilitate or outsource one or more aspects of the business, product and service operations provided on Relief, including search technology, payments, affiliate and rewards programs, maintenance services, database management, etc.

1.6 “Intellectual Property Right” shall mean any patent, trade mark, trade name, service mark, service name, design, design right, copyright, database right, moral rights, technical know-how, trade secret and other confidential information, rights in the nature of any of these items in any country, and rights to sue for passing off or other similar intellectual or commercial rights (in each case whether or not registered) and registrations of and applications to register any of them.

1.7 "Law" shall mean all the applicable statutes, enactments, acts of legislature, laws, ordinances, rules, bylaws, regulations, notifications, guidelines, policies, directions, directives, and orders of any government and or any Authority.

1.8 "Losses" shall include, without limitation, losses, liabilities, actions, suits, claims, proceedings, costs, damages, judgments, amounts paid in settlement and expenses, etc.

1.9 "Pay Facility" means the automated electronic payment or collection and remittance facility provided by Relief to users to facilitate payments for paid services of the Relief directly through banks or indirectly third-party payment gateway facility providers to provide enabling support for collection and remittance of payment on Relief.

1.10 "Person" shall mean and include any individual, legal entity, company, body corporate, partnership firm, association, limited liability partnership, or proprietorship, whether incorporated or not.

1.11 "Policies" shall mean and include the Privacy Policy, rules and policy of the third party Payment Facility, and any other policies of Relief as amended, provided, or communicated to you from time to time.

2. General

2.1 These Terms contain rules and regulations, policies, notifications, covenants, and agreements applicable to any Person who may access or use the mobile application "Relief " as modified and updated from time to time and You hereby agree and acknowledge to be bound by the Terms of Use.

2.2 Relief reserves the right to modify the application and/or alter these terms, provisions, and/or Policies from time to time according to the development of the technology, business operation, legitimate environment, or other situation in necessity; and the amendment, modification, alteration or any change stipulated hereto (“Amendment”) shall become an integral part of this Terms of Use, with equal legal effect with. Though Relief may notify you of such Amendments by making in-app public notice, WE RECOMMEND YOU TO REVIEW THIS TERMS OF USE PERIODICALLY FOR THE MOST UP-TO-DATE VERSION. Your continued use of Relief means your consent of such Amendments.

2.3 In order to use Relief, you need to be 13 (thirteen) years of age or older Relief may only be used or accessed by such Persons who are of the full capacity of civil conduct. If you access or use Relief by providing false representation of your age, you and your guardians shall undertake the consequential liabilities of doing so as per the applicable laws and regulations; and Relief shall be discharged of the legal consequences.

Notably, if You are a natural person and you are a minor, please read and accept this Terms of Use, and access and use Relief under the accompany of your natural or appointed guardian. Minors shall be subject to retrained access to and use of Relief within a reasonable scope. You fully understand that Relief shall not be liable for the review or confirmation of the foregoing matters under this provision.

2.4 Feedback

We welcome your comments and recommendations for improvements to the Services (“Feedback”) You can submit feedback by emailing us at service@getmorelief.com. Notwithstanding anything to the contrary, we are the sole owner of all Feedback, including any suggestions, enhancement requests, recommendations, or other feedback provided by you to us, and you hereby assign to us, without limitation of any kind, all of your rights, titles, and interests therein, and we accept such assignment.

3. Subscription Fees and Payments

3.1 payments

Relief offers certain enhanced features of the Services which you can purchase as a monthly, or yearly subscription (“Subscription”). Relief may also offer lifetime subscriptions that are valid for the shorter of 100 years or until we cease to commercially offer the Services. A description of features associated with Subscriptions is available via the Services.

Relief may also offer products and services for purchase("In-App Purchase") through iTunes, and Google Play ("Application Store"). If you choose to make a Subscription or an In-App Purchase, you will be prompted to confirm your purchase with the applicable payment provider (such as Application Store) and your method of payment (your credit/debit card or a third-party account such as iTunes or Google Play Account)("Payment Method") will be charged at the prices displayed to you for the service(s) or product(s) you've selected as well as any taxes (if applicable) that may be imposed on your payments, and you authorize Relief or the third party account to charge you. Your order is not binding on Relief until accepted and confirmed by Relief.

If you have any concerns or objections regarding charges, you agree to raise them with us first and you agree not to cancel or reject any credit card or third-party payment processing charges unless you have made a reasonable attempt at resolving the matter directly with Relief.

3.2. Auto-renew

If you purchase an auto-recurring periodic subscription, your Payment Method will continue to be billed for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing. If you do not wish your subscription to renew automatically, or if you want to change or terminate your subscription, you will need to log in to your Application Store account and follow instructions to cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the Relief application from your device. Deleting your account on Relief or deleting the Relief application from your device does not cancel your subscription. Relief will retain all funds charged to your Payment Method until you cancel your subscription on the Application Store account. If you cancel your subscription, you may use your subscribed product(s) or service(s) until the end of your then-current subscription term, and your subscription will not be renewed after your then-current term expires.

3.3. Refund

Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods. We may make an exception if a refund for a subscription offering is requested within fourteen days of the transaction date, or if the laws applicable in your jurisdiction provide for refunds.

To request a refund:

If you subscribed using your Apple ID, refunds are handled by Apple, not Relief. To request a refund, go to iTunes, click on your Apple ID, select "Purchase history," find the transaction, and hit "Report Problem". You can also submit a request at https://getsupport.apple.com.

If you subscribed using your Google Play Store account, please contact our Customer Support Team with your order number for the Google Play Store (you can find the order number in the order confirmation email or by logging in to Google Wallet).

3.4 Change to the pricing terms

Relief reserves the right to change its pricing terms for Subscriptions at any time and Relief will notify you in advance of such changes becoming effective. Changes to the pricing terms will not apply retroactively and will only apply for Subscription renewals after such changed pricing terms have been communicated to you.

You agree that your purchases are not contingent on the delivery of any future functionality or features, or dependent on any oral or written public comments made by Relief regarding future functionality or features.

4. Registration and Creation of an Account:

4.1 You may choose to register and create an account on your own by creating a username and password and providing necessary details of yourself in order to access comprehensive functions and Services on Relief.

4.2 You hereby agree and acknowledge that Relief will grant access to any person who has obtained your username in the same manner as it would have granted access to you, and you shall be responsible for all activities conducted through your account in your name of you.

4.3 You are solely responsible for maintaining secrecy and confidentiality of your account details including your user name, mobile phone number, password, and other information; and, you are fully aware that you are also solely responsible for the consequences of granting use by a third-party of your account, directly or indirectly.

4.4 You acknowledge and agree that the information you provide when registering your account is true, accurate, complete, legal, and in effect.

4.5 You shall immediately notify Relief of any actual or suspected unauthorized use of your account. Although Relief, its management team, shareholders, employees, associates, contractors, or agents ("Personnel") shall not be responsible in any manner for any Losses occurring from any unauthorized use of your account due to your deliberate or negligent breach of keeping the secrecy of your account information, you may be liable for the losses of Relief or such other parties as the case may be, due to any unauthorized use of your account.

4.6 Except otherwise provided by other Policies of Relief, you agree that the sole purpose of registering on or using Relief is to be a user to enjoy the Services provided by Relief, and you shall not use Relief in any manner for any illegal purpose under the applicable Law.

5. Account Termination Policy

5.1 Relief is entitled to suspend or terminate your account if you provide, or Relief has reasonable ground to believe that you provide, the account details are untrue, invalid, or inaccurate.

5.2 Relief reserves the right to decide whether to suspend or terminate your account if it is reasonable for Relief to believe that the Content you generate, create, upload, comment or share on Relief is illegal, of obscenity or pornography, or in infringement to the third-party’s lawful right.

6. General Use of the Service

Relief grants you access to it for use and enjoy the Service provided that you are in compliance with the following terms and conditions:

6.1 If you provide any information that is untrue, inaccurate, not current, or incomplete, other than those you provide when registering your account, or Relief has reasonable grounds to believe that such information is untrue, inaccurate, not current or incomplete, or not in accordance with this Terms of Use, Relief reserves the right to indefinitely suspend or terminate or block Your use or access to Relief in any manner whatsoever. Should any other Person act upon such untrue, inaccurate, not current, or incomplete information provided or verified by you, Relief, and its Personnel shall not be liable for any damages, losses, direct, indirect, immediate, or remote, interests or claims, etc. resulting from such information to you or to any third party. You hereby indemnify and agree to keep harmless Relief in accordance with the Indemnity clause contained in this Terms of Use.

6.2 no decompile

You must not (or assist others to) access, use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sublicense, transfer, display, perform, or otherwise exploit our Services in impermissible or unauthorized manners, or in ways that burden, impair, or harm us, our Services, servers, systems, our users, or others, including that you must not directly or through automated means:

(i) reverse engineer, alter, modify, create derivative works from, decompile, or extract code from our Services;

(ii) send, store, or transmit viruses or other harmful computer code through or onto our Services;

(iii) gain or attempt to gain unauthorized access to our Services, servers, or systems;

(iv) interfere with or disrupt the integrity or performance of our Services;

(v) create accounts for our Services through unauthorized or automated means;

(vi) collect the information of or about our users in any impermissible or unauthorized manner;

(vii) sell, resell, rent, or charge for our Services;

(viii) distribute or make our Services available over a network where they could be used by multiple devices at the same time;

(ix) use any robot, spider, other automated devices, or manual process to monitor or copy any content from Relief;

(x) attempt to or circumvent or manipulate any of the other obligations imposed by this Terms of Use and/or Relief Policies.

6.3 no commercial use of the Service

You agree not to take advantage of Relief’s Services for commercial use, such as the sale of the access to Relief, sale of the in-app advertising, sponsorship or promotion opportunities on Relief, etc., without prior written consent from Relief. You shall never copy, distribute, exchange, modify, sell or transmit anything from Relief, including but not limited to the Services on Relief, except as permitted in advance by Relief and the applicable Law.

6.4 no robot

you should not access Relief by or through any technology stimulating a real user or automated system, and such technology includes, without limitation, robots, spiders, or offline readers that access Relief in a repeatedly way within a period more frequently than a human being can physically produce within a such time period.

6.5 sharing content & no content distribution

you acknowledge and agree that you will not share, distribute, modify, reproduce, transfer, or in other ways commercialize the Content that you are not authorized to on Relief, directly or indirectly, in-app or in other distribution channels (including but not limited to the websites, apps, or media), without Relief’s prior written consent.

7. Your Content/Use of Content

7.1 content provided on an as-is basis

You acknowledged with sufficiency that the Content on Relief is provided to you AS IS. You may access and enjoy the Services and the Content on Relief solely for personal use and in compliance with the applicable Laws.

7.2 content restrictions

You agree and undertake not to host, display, upload, modify, publish, transmit, update or share any Content or list any Content or item or use Services on Relief in a way that:

(i) Using account belongs to another person and to which You do not have any right to, accessing and enjoying the Service of Relief ;

(ii) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, brutal, hateful, cruel, insensitive, insulting, loathing in nature, hurting religious or other sentiments, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling or hijacking, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing;

(iii) harms minors in any way;

(iv) infringes any patent, trademark, copyright, or other proprietary rights or third party’s trade secrets or rights of publicity or privacy or is fraudulent or involves a scam or the sale of or services using counterfeit or stolen items;

(v) violates any law for the time being in force;

(vi) deceives or misleads the Users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

(vii) impersonates another person or uses an anonymous proxy;

(viii) contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer resource, that describes or interferes with or harms or violates the security of Relief or any of its services, system resource, source code, accounts, passwords or networks connected to or accessible through Relief or any linked sites, if any; or contains any trojan horses, bugs, bots, worms or other computer programming routines that may damage, detrimentally interfere with, diminish the value of, surreptitiously intercept or expropriate any system, data or personal information;

(ix) threatens the unity, integrity, defense, security, or sovereignty where Relief operates, friendly relations with foreign states, or public order or causes incitement to the commission of any offense or prevents investigation of any offense, or is insulting any other nation; is false, inaccurate or misleading; directly or indirectly, offers, attempts to offer, trade or attempts to trade in any item/service, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable Law;

(x) may give rise to liability on part of Relief or cause any hindrance (in whole or in part) with respect to the services of Internet Service Providers or other suppliers of the App or the Company including Internal Service Providers;

(xi) links directly or indirectly to or includes descriptions of items that are prohibited under the applicable Laws;

(xii) attempt to or circumvent or manipulate any of the other obligations imposed by this Terms of Use and/or Relief Policies.

7.3 no content generation liability Relief does not have any role in the creation of content on Relief, as a meditation platform. Notwithstanding anything contained herein, Relief specifically disclaims all liability arising out of the Content. You retain all rights in and are solely responsible for the Content that you generate, create, submit, comment, upload, post, or display on or through the App. You should only provide Content that you are comfortable sharing with others. Relief reserves the right to remove Content alleged to be infringing or violating any lawful right or applicable Law without prior notice, at our sole discretion of Relief.

7.4 acknowledge inappropriate content Relief does not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, legality, suitability, or reliability of any Content posted via the Services on Relief. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate, or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. All Content is the sole responsibility of the person who originated such Content. If you discover any of the situations as stipulated under Article 6.2 contained in the Content, you may contact us by email at service@getmorelief.com with the related proof such as screenshots, to support your claim.

8. Warranties and Representations

8.1 no conflict You acknowledge and agree that accepting and entering this Terms of Use will not conflict with, result in a breach of or constitute a default (or any event that, with notice or lapse of time, or both, would constitute a default) or result in the acceleration of any obligation under any of the terms, conditions. Covenants, or provisions of any other agreement or instrument to which you are a party or by which you are bound or to which any of your property or assets are subject, conflict with or violate any of the provisions of its charter documents, or violate any statute or any order, rule or regulation of any Authority that would materially and adversely affect the performance of your duties hereunder. You have obtained any consent, approval, or authorization of the Authority required for the execution, delivery, and performance of its respective obligations hereunder. If Relief suffers any loss or damages or a claim is made by any Person against Relief as a result of a breach or default or contravention on your part of this Terms of Use or other Relief Privacy Policy, you agree to, forthwith upon delivery of notice by Relief, make good such losses or damages or claim amounts to Relief all such losses or damages.

8.2 no litigation/proceeding You confirm that there is no action, suit, or proceeding pending against you or to your knowledge, threatened in any court or by or before any other Authority which would prohibit your entering into or performing obligations under this Terms of Use or other Relief Privacy Policy.

8.3 no assign of the account You acknowledge and agree that you shall not transfer Your account and shall not assign any rights and obligations under these Terms and Policies to any third party without the specific written permission of Relief.

9. Intellectual Property

9.1 mutual grants of IP use In order to operate and provide our Services, You grant Relief a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the Content in connection with the Services. The rights you grant in this license are for the limited purpose of operating and providing our Services, including, without limitation, promoting the Content for your benefit in or through other media formats or channels.

9.2 mutual grants of IP use We grant you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use our Services, our trademarks, icon, logo, and other marks related, subject to and in accordance with this Terms of Use. This license is for the sole purpose of enabling You to use our Services, in the manner permitted by our Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you.

9.3 in-app punishment measure Relief reserves the right to remove Content alleged to be infringing without prior notice, at our sole discretion, and without liability to You. We will respond to notices of alleged infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please report this at service@getmorelief.com.

10. Third-Party Link

You acknowledge and agree that Relief might contain links leading you to another website/website or sources (the “Third-party Link”), and Relief has no control over the activities or contents on the landing pages of such Third-party links. Thus Relief is not liable for the contents or activities carried out on the landing pages of the Third-party links. We recommend you carefully review the respective Terms of Use and the Privacy Policy of such Third-party sources when you leave Relief by clicking the Third-party links and jumping to the landing pages.

11. Privacy Policy and Information Disclosure

11.1 Our Privacy Policy describes what kind of information we collect, and how we handle the information You provide to us when You use Relief. You understand that through your use of the Services You consent to the collection and use (as set forth in the Privacy Policy) of this information, including the storage, processing, sharing, and use of this information, and the protection policy by us.

11.2 Relief views the protection of users’ privacy as a very important community principle. Relief clearly understands that the information provided by you, personal or non-personal, is one of the most important assets to Relief. Relief stores and processes the information provided by you that are protected by physical as well as reasonable technological security measures and procedures in compliance with the applicable Law.

11.3 Relief may need to disclose your personal and other information or Contents provided by you when required by law or the competent governing bodies, in relation to compliance with a court order, ongoing judicial proceeding, administrative proceeding, or any other legal process or request to Relief brought in any country/region where Relief carries out business, or to exercise Relief’s legal rights or defend against legal claims.

11.4 YOU ACKNOWLEDGE AND AGREE THAT Relief may also disclose your personal and other information you provide, to another third party as part of a re-organization or an investment into the Company or a sale of any or substantially all of the business of the Company. Any third party to which Relief or its shareholders transfer or sell Relief’s shares or assets will have the right to continue to use the personal and other information that you provide.

12. Breach, Remedies, and Indemnification

12.1 punishment measures Under the circumstance of any of your breach of this Terms of Use provided hereto, without limiting other remedies, Relief may pursue, at its sole discretion, take such action as it deems fit, including but not limited to (i)suspension or removal of the Content you generate, create, upload or share; (ii)limitation, suspension or cancellation of your account, (iii)limitation or cessation of your access or use of Relief ; (iv)limitation, suspension or cessation of your Payment Facility gateway on Relief ; (v) removal or deletion of your information; (vi) report to the competent Authority and coordinate with the investigation; (vii)legal remedies applicable under the Laws; and/or (v) other applicable methods that Relief deems fit on a case-by-case basis. shall not be responsible and/or liable for removing or deleting such information.

12.2 indemnification You shall indemnify and hold harmless Relief, its subsidiaries, Affiliates, Internal Service Provider and their respective officers, directors, agents, and employees, from and against any and all losses, liabilities, actions, suits, claims, proceedings, costs, damages, judgments, amounts paid in settlement and expenses (including without limitation attorneys' fees and disbursements), made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, including the Policies incorporated herein, by reference, or your violation of any applicable Law, rules or regulations or the rights of a third party or resulting from untrue, inaccurate, not current or incomplete information provided or verified by You.

13. Warranty Disclaimers

YOU ARE FULLY AWARE THAT Relief IS A MOBILE PLATFORM OF MEDITATION SO THAT YOUR USE OF THE SERVICES ON Relief SHALL BE SOLELY AT YOUR OWN RISK. Relief, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. Relief MAKES NO WARRANTIES OR REPRESENTATIONS WITH REGARD TO THE ACCURACY OR COMPLETENESS OF THE CONTENTS ON Relief OR CONTENT FROM ANY WEBSITE/RESOURCE OR LINKED TO Relief; AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I)ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II)PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III)ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/ALL FINANCIAL INFORMATION STORED THEREIN, (IV)ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF THE SERVICES. Relief DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICES ADVERTISED OR PROVIDED BY ANY THIRD PARTY THROUGH Relief OR THROUGH HYPERLINKED IN ANY ADVERTISING PLACEMENTS ON Relief. YOU ACKNOWLEDGE THAT Relief WILL NOT BE A PARTY TO OR IN ANY WAY BE LIABLE FOR MONITORING THE TRANSACTION, IF ANY, BETWEEN YOU AND ANY OTHER USER OF Relief OR ANY THIRD PARTY, WHERE SUCH TRANSACTION IS NOT PART OF THE SERVICES PROVIDED BY Relief.

14. Limitation of Liability

In no event shall Relief , its officers, directors, employees, or agencies, affiliates, service providers and Internal Service Providers be liable for any direct, indirect, incidental, punitive, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising (in any manner whatsoever) out of or in connection with (i)errors, mistakes, omissions, or inaccuracies of Content; (ii)personal injury or property damage, of any nature whatsoever, resulting from your access to and use of Relief ; (iii)any unauthorized access to your secure servers and/or all personal information therein; (iv)any interruption or cessation of use or Services on Relief ; (v)any bugs, virus, trojan horses, or the like, which may transmitted to or through our servers by any third party; (vi)any loss or damage incurred as a result of your use of the Services, and/or (vii) any delay, failure, interruption or errors in connection with the Pay Facility, whether based on warranties, contracts, torts, or any other legal theory, and whether or not Relief is advised of the possibility of such damages. The limitation of liability under this provision shall apply to the full extent permitted by the applicable Laws.

15. Report of Grievance

In case of any grievance, objection, or complaint on your part with respect to Relief, other users of Relief, including any complaints or inquiry about the measures Relief taken with respect to your use of Relief, you should promptly raise such grievance or complaint to our designated email address for grievance receiving at service@getmorelief.com and provide us with all necessary information and/or documents to enable the Relief to try and resolve the issue(s).

16. Miscellaneous

16.1 No actions, omissions, or decisions taken by Relief shall be deemed a waiver of any rights or claims that Relief may have against the user. Any user that may have taken measures by Relief such as account suspension or Content deletion may not register/restore or attempt to register/restore the Relief account or the respective Content in any manner whatsoever until such time that such user is reinstated by the Relief. Notwithstanding the above, if you breach this Terms of Use or the Policies and other documents incorporated therein by reference or any other agreements entered into between Relief and you in addition to this Terms of Use and/or the Policies, apart from the measures stated under Article 11, Relief reserves the right to take strict legal action including but not limited to referral to the appropriate police or other authorities for initiating criminal or civil or other proceedings against you.

16.2 None of the provisions of this Terms of Use shall be deemed to constitute a partnership or joint venture or agency between you and relief, and you shall have no authority to bind Relief in any manner whatsoever.

16.3 Except as explicitly stated otherwise, any notices directed to Relief shall be given by email to service@getmorelief.com and any notice to you by Relief shall be provided to you by in-app public notice and you shall pay attention to the in-app notification on the first page of Relief from time to time. Notice shall be deemed to be delivered as soon as it has been given. It shall be your sole obligation to keep Relief updated about any change in your contact details. Failure in the notice of the in-app notification on the part of the user, or failure to receive the notification on the part of the user due to negligence to update the contact details on Relief, shall not render such notices invalid.

16.4 If any clause of this Terms of Use and/or the Policies thereof shall be deemed invalid, void, or for any reason unenforceable to any extent, the remainder of this Terms of Use and/or the Policies other than those as to which it is held invalid or unenforceable shall not be affected thereby, and each provision of this Terms of Use and/or Policies shall be valid and enforceable to the fullest extent permitted by applicable Laws.

16.5 This Terms of Use, together with the other Policies, entered between Relief and you, incorporated herein by reference, constitute the entire understanding and agreement between you and Relief with respect to the subject matter herein.

16.6 Subject to the Dispute Resolution hereunder and to any dispute resolution agreement separately agreed between Relief and you in any other agreements, all remedies of Relief and users under this Terms of Use whether provided herein or conferred by statute, civil law, common law, custom or trade usage, are cumulative and not alternative and may be enforced successively or concurrently.

17. Confidentiality

17.1 You acknowledge and agree that Relief does not represent or warrant maintaining the confidentiality of Content shared, transferred, uploaded, commented, or posted by you; although our endeavor is always to ensure reasonable efforts to maintain the confidentiality of the information of your account, payment process or other information that Relief bears the confidentiality responsibilities under the applicable Laws in accordance with Relief Privacy Policy.

17.2 All confidential information given to or received by you from Relief shall be kept confidential by You (whether or not such information or data has been marked as confidential) unless specifically permitted to the contrary in writing from Relief.

17.3 Further Relief may at any time disclose any confidential information on a confidential basis to any prospective and current investors, strategic or financial, partners, or service providers other than users of Relief.

17.4 This confidentiality obligation shall survive the termination of this Terms of Use.

This Terms of Use is stipulated in accordance with and shall be governed and construed under the laws of Hong Kong. If any dispute arises between you and the Company during your use of Relief, and no consensus could be reached after you deliver your concern to our service@getmorelief.com and discuss it with our staff, then either you or Relief could refer such dispute to the competent court in Hong Kong.
